Don't Get Me StartedSupreme Court bombs outBy ANDY HEFTY JACKSONVILLE, FL - Without a doubt, five members of the Supreme Court of the United States have complete and utter contempt for the citizens of this country. Five justices. Count them: Five. Stevens, Souter, Ginsburg, Bryer, and Kennedy all decided that the supposed rights of enemy terrorists trump the President’s mandate to protect the very citizens the terrorists wish
Americans depend on the government for one thing above all else: protection. We have police, fire, rescue, emergency management and our armed forces. The mission of the military is primarily to protect its citizens. Before you ultraliberals and libertarian purists send me any hate mail, remember that these terrorists were captured on the field of battle, fighting our troops, in Afghanistan. This decision has nothing to do with Iraq, so let’s save that fight for another day, shall we? As our brave Soldiers and Marines overtook al Queda training grounds, hideouts, and camps, they rounded up and captured hundreds of men. At the very outset, they began sifting through them to determine who were truly loyal to Osama and who were forced into serving him. Those determined to be a threat were placed in a holding camp until Guantanamo Bay was ready to receive the terrorists. (I know, I keep repeating that term. There are other terms I would like to use, but I don’t use that language. Insert your own expletive if you like.) Once these terrorists arrived in sunny, tropical Cuba, they were cleaned up, given proper medical treatment, clean clothes, a new Koran, a new prayer rug, and all the halal (Muslim equivalent to kosher) food they could eat. A group of Muslim chaplains have been assigned to them for counseling and calls to prayer. The Marines at Guantanamo have exercised the most incredible amounts of restraint as the terrorists have conducted unspeakable acts toward their gracious captors. I won’t get into details. A friend of mine who visited Cuba as the camp was first established told me all the horrors the Marines have to endure. They are not fit for this column. But these unspeakable acts are conducted to garner press attention. It worked. Remember the Newsweek report about the "flushed Koran"? Newsweek has yet to apologize for the report turning out to be a complete fabrication -- a hoax. Now, these terrorists (again, insert your own expletive) have demanded that they use our court system for their own version of justice. The very people who are trying to destroy our way of life want to use our way of life for their own benefit. Picture this scenario as a terrorist stands in a DC courtroom: "Your Honor, I hate this country and I want to destroy it, but I want to take full advantage of its benefits in my quest to conquer you." Well, apparently, the Supreme Court agrees. There are now over 200 cases pending in the DC Court of Appeals. That number will certainly balloon more rapidly than a rookie linebacker at the buffet table. Lawyers across the country will abandon their ambulance-chasing and catch the first flight possible to Cuba. Too bad our own citizens can’t file grievances with the government with this kind of national attention. I seem to recall our Bill of Rights in the Constitution protecting the rights of Americans first and foremost. These terrorists are not here to enjoy life, liberty, and the pursuit of happiness. They are after death, destruction, and persistent enslavement. But too many bleeding hearts want to blur the lines between justice and military action so the French won’t hate us. Here’s what the Supreme Court had to say in its ruling: In considering both the procedural and substantive standards used to impose detention to prevent acts of terrorism, proper deference must be accorded to the political branches. … Unlike the President and some designated Members of Congress, neither the Members of this Court nor most federal judges begin the day with briefings that may describe new and serious threats to our Nation and its people. The law must accord the Executive substantial authority to apprehend and detain those who pose a real danger to our security. Gee, you think? Then why rule the way you did? This is not a case of who’s at fault for hot coffee being spilled at the drive-through. This is about the proper execution of war and the prevention of another 9/11 -- or worse. "Substantial authority" has just been snatched from the President. Chief Justice Roberts wrote the following about who the "winners" are in his dissent:
Not the rule of law, unless by that is meant the rule of lawyers, who will now arguably have a greater role than military and intelligence officials in shaping policy for alien enemy combatants. And certainly not the American people, who today lose a bit more control over the conduct of this Nation’s foreign policy to unelected, politically unaccountable judges. I respectfully dissent. Well, I fully disrespectfully dissent. These clowns are getting to be far too generous with supposed rights than I care to imagine. Trust me on this one thing: If any Americans are killed by soon-to-be-former Guantanamo prisoners because of this ruling, there will be blood on the hands of five Justices of the Supreme Court -- and the presidents who appointed them and the Senators who confirmed them. Todd Beamer could not be reached for comment. Neither could firefighter Brian Cannizzaro. Nor Johnny "Mike" Spann. Nor could the others who died on that dreadful day or afterwards while bringing justice to groups bent on our destruction.
